What these terms cover
This website at dayzlegame.com is operated by Coordn8r Software Inc. (“Dayzle”, “we”, “us”), a company incorporated in Ontario, Canada, at [REGISTERED ADDRESS], Ontario, Canada.
By visiting or using this site, you agree to these Terms of Use. If you don’t agree, please don’t use the site.
These terms cover the marketing site only. Two other documents apply elsewhere:
- The App Terms of Service govern the Dayzle app on iOS, Android, and the web version at play.dayzlegame.com, including accounts, subscriptions, and leaderboards.
- The Privacy Policy covers all of it, and explains what we collect and why.
We may update these terms at any time by posting a new version here. The “last updated” date reflects the current one, and continuing to use the site means you accept it.
Dayzle is offered in Canada and the United States. This site is reachable from anywhere, but it is not an offer of our products or services outside those countries, and it is not directed at any other region. If you visit from elsewhere, you do so on your own initiative and are responsible for complying with your own local law.
Using the site
You may read this site, share links to it, and quote reasonable extracts with attribution. That’s what it’s for.
Please don’t:
- Copy, republish, or redistribute substantial portions of the site’s text, artwork, or design as your own.
- Scrape the site at a rate that burdens it, or use automated tools to harvest its content in bulk — including for training a machine-learning model.
- Attempt to gain unauthorised access to the site, its servers, or any connected system, or probe it for vulnerabilities without our written permission. If you find something, please tell us at hello@dayzlegame.com — we will thank you, and we will not pursue a good-faith report.
- Introduce malware, or interfere with the site’s availability for anyone else.
- Use the site in any way that breaks the law, or to impersonate Dayzle or anyone associated with it.
Intellectual property
The content of this site — text, images, illustrations, screenshots, the Dayzle name, the Dayzle logo, and the overall look and feel — is owned by Coordn8r Software Inc. or our licensors and is protected by copyright, trademark, and other laws.
Nothing here grants you a licence to use our trademarks. Press and reviewers are welcome to use our name and screenshots to write about Dayzle; email us if you want assets.
Accuracy of what’s on the site
We try to keep this site accurate and current, but it is marketing material describing a product that changes. Features, screenshots, game lists, availability, and pricing described here may differ from what actually ships, and may change without notice. Nothing on this site is an offer, a warranty, or a binding commitment. The App Terms of Service and the in-app purchase screen govern what you actually get.
On brain games specifically: nothing on this site should be read as a claim that playing Dayzle will improve your cognitive abilities, prevent cognitive decline, or reduce your risk of any medical condition. Dayzle is entertainment. See “What Dayzle is not” in the App Terms.
Links to other sites
This site links to third-party destinations, including the Apple App Store and Google Play. We don’t control those, we’re not responsible for their content, and a link isn’t an endorsement. Their terms and privacy policies apply once you leave.
Privacy and cookies
How we handle personal information — including this site’s server logs, the Google-hosted web font it loads, and the product analytics that is currently switched off — is described in the Privacy Policy.
Disclaimers
This site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Coordn8r Software Inc. and its directors, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this site. Our total aggregate liability relating to this site is limited to CAD $100.
Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer in Ontario, elsewhere in Canada, or in a US state whose law does not permit these exclusions, your statutory rights are unaffected and the exclusions do not apply to you.
Governing law and disputes
These Terms of Use are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of Ontario have jurisdiction over disputes about this site.
If you are a consumer in Ontario or another Canadian province, nothing here waives a right your provincial consumer protection legislation gives you — including your right under Ontario’s Consumer Protection Act, 2002 to bring an action in court. If you are a consumer elsewhere, this choice of law does not deprive you of the protection of the mandatory consumer laws where you live.
Note that the App Terms of Service contain their own dispute resolution provisions, including arbitration with an opt-out; those apply to the app, not to this site.
General
- Severability. If a provision is unenforceable, it is modified to the minimum extent needed or severed, and the rest stands.
- No waiver. Not enforcing something immediately doesn’t waive our right to enforce it later.
- Entire agreement. These terms, plus the Privacy Policy, are the whole agreement about your use of this site.
